Terms of Service


 

Introduction

These terms of service (the “TOS”) govern your use of the web hosting services (the “Services”) provided by Knotberry doo Beograd (the “Service Provider”). By using the Services, you agree to be bound by the TOS. If you do not agree to the TOS, you may not use the Services.

Privacy Policy

We undertake to protect the privacy of all our customers. We collect only necessary, basic data on customers and data necessary for business operations and informing customers in accordance with good business practices and in order to provide a high-quality service. We provide our customers the option to decide whether or not they want to be removed from mailing lists used for marketing campaigns. All customer data is strictly stored and is available only to employees who require this data for the performance their work. All employees of Service Provider are responsible for adherence to the principles of privacy protection. By agreeing to these Terms of Service, you also acknowledge and agree to our Privacy Policy, which outlines how we collect, use, and protect your personal information.

Description of Services

The Services provided by Service Provider include the storage and hosting of web content, as well as the provision of associated services such as email hosting and domain registration.

Your Responsibilities

You are responsible for the content and information that you upload to the Services, and you agree to use the Services only for lawful purposes. You also agree to comply with all applicable laws and regulations in connection with your use of the Services.

Prohibited Uses

You may not use the Services to:

  • Engage in any activities that are illegal under applicable law.
  • Host, distribute, or link to any illegal or infringing content, including but not limited to copyrighted material, trademarked material, or material that is obscene or defamatory.
  • Violate the rights of third parties, including posting or distributing private information about third parties without their consent, violating intellectual property rights, or posting or distributing defamatory information about third parties.
  • Post or distribute information that promotes violence or extremism, incites racial or national hatred.
  • Process personal data of third parties without the consent of the data subjects or without other legal grounds for such processing.
  • Post or distribute any information (infected with viruses or containing malicious components) that can harm and cause losses to the Service Provider and/or third parties.
  • Engage in any activity that is harmful to Service Provider or its other customers, such as hacking, spamming, or other forms of unauthorized access.
  • Send spam using the Service Provider's equipment or engage in passive spam (sending spam without using the Service Provider's equipment but containing a link to the Service Provider's website).
  • Scan elements of the internet for vulnerabilities, attempt unauthorized access to computer systems.
  • Use a nonexistent or fake email address as a return address when using the Service Provider's equipment.
  • Use the Service Provider's resources to provide mass public email services, VPN services, or proxy services.
  • Host applications used for obtaining/mining cryptocurrencies.
  • Engage in any actions that may disrupt the normal functioning of the Service Provider's equipment and/or software or that of third parties.
  • Attempt to access the Service Provider's resources or any internet resources belonging to third parties without their consent, including cybersquatting.
  • Host websites that force redirection to external resources that violate these Rules or contain links in their content to external resources that violate these Rules.
  • Engage in inappropriate behavior, insults to the Service Provider's representatives, or the use of obscene language.

Abuse Policies and Termination

The Service Provider takes all necessary measures to ensure that the following rules are not violated (intentionally or unintentionally) by the Client. The basis for investigating a potential violation of these rules is a complaint, supported by the original text of the message, received from a telecommunications operator, another organization, or third parties whose legal rights have been infringed. If you believe that someone is using the Services in violation of the TOS, please contact the Service Provider immediately at abuse@hostlord.com. The Service Provider will investigate any reported violations and take appropriate action.

Violation of the applicable laws may result in civil and/or criminal liability. The Service Provider will cooperate with any law enforcement authorities or court order requesting or directing the Service Provider to disclose the identity of anyone believed to have violated the laws.

Service Provider reserves the right to terminate your use of the Services at any time, without notice, for any reason, including but not limited to violation of the TOS.

Disclaimer of Warranties

The Services are provided “as is” and Service Provider makes no representations or warranties of any kind, express or implied, as to the operation of the Services or the information, content, materials, or products included on the Services. Service Provider does not warrant that the Services will be uninterrupted or error-free, and Service Provider will not be liable for any interruptions or errors.

Limitation of Liability

Service Provider will not be liable for any damages of any kind arising from the use of the Services, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

Payments

  • Subscription Fees and Refunds: Users agree to pay the subscription fees as outlined on the pricing page for either monthly or yearly subscription plans. All payments are final, but refunds may be issued under specific conditions as outlined below and in cases where a refund is required by law. Refunds for internet domain registration are not possible. In the event of refunds to the customer who previously made the payment via a payment card or via IPS, partially or in full, and regardless of the reason for the return, the Service Provider shall make the refund exclusively via DINACARD, VISA, EC/MC, and Maestro payment methods or the IPS payment system.
  • Currency and Payment Methods: All payments will be made in the local currency of the Republic of Serbia - Serbian Dinar (RSD). The informative presentation of prices in other currencies will rely on the middle exchange rate of the National Bank of Serbia. The amount charged to your payment card or account will be expressed in your local currency through conversion into the same currency at the exchange rate used by card organizations, which cannot be known to us at the time of the transaction. As a result of this conversion, there is a possibility of a slight deviation from the original price listed on our site. Thank you for understanding.
  • Protection of confidential transaction data: When entering payment card data, confidential information is transmitted via a public network in a protected (encrypted) form using SSL protocols and PKI systems, as currently the most modern cryptographic technology. The complete billing process is performed on the Institution’s websites. At no time is payment card data available to our system.

Cancellation

  • Subscription Cancellation: Users may cancel their subscription at any time. Cancellation will become effective at the end of the current billing cycle. No refunds will be provided for unused portions of the service, including partial months or years of service.
  • Invoices: Users will receive an invoice at the beginning of each billing cycle. Subscriptions are not automatically renewed, and users are responsible for paying each invoice to continue their service.

Complaint Policy

  • Filing a Complaint: Users may submit complaints regarding the service (such as downtime, billing errors, or other issues) via the designated customer support portal or by contacting support via email. Complaints must be submitted within 30 days of the issue occurring.
  • Response Time: We will acknowledge complaints within 48 hours and make every reasonable effort to resolve them within 7 business days.
  • Resolution: We will work to resolve the complaint with solutions including but not limited to technical support, adjustments to the account, issuing service credits or a refund if applicable.

Domain Registration Policies

  • Eligibility: By registering a domain through our service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement. Domain Name Selection: You are responsible for selecting an appropriate domain name that does not infringe on any trademarks or intellectual property rights of any third party. We reserve the right to cancel or transfer any domain registration that we deem to be inappropriate or in violation of our policies.
  • Payment and Renewal: You are responsible for paying all fees associated with the registration and renewal of your domain name. We will send you renewal notices prior to the expiration of your domain name, but failure to renew your domain name on a timely basis may result in the loss of your domain name.
  • Domain Transfer: You may transfer your domain name to another registrar at any time, but you are responsible for ensuring that the transfer is done in accordance with the policies of the other registrar.
  • Domain Abuse Policy: You may not use your domain name for any illegal or malicious activities, including but not limited to spamming, phishing, malware distribution, or any other activities that violate our acceptable use policy. We reserve the right to cancel or transfer any domain registration that we deem to be in violation of our abuse policy.
  • Disclaimer: We make no representations or warranties of any kind with respect to the availability, reliability, or security of our domain registration service. We will not be liable for any damages of any kind arising from the use of our service or the loss of your domain name.

Governing Law

The TOS and your use of the Services will be governed by and construed in accordance with the laws of the Republic of Serbia, without giving effect to any principles of conflicts of law.

Changes to TOS

The Service Provider reserves the right to change the TOS at any time, without notice. Your continued use of the Services following any changes to the TOS will be deemed acceptance of the new terms.
